Alan Reider, JD, MPH, Washing-
ton, D.C., and Candace Simerson,
COE, Minneapolis, highlighted
compliance. Mr. Reider discussed the
anti-kickback statute and the consid-
erations that ophthalmologists must
be aware of when giving anything
of value to referral sources. He first
posed questions to the audience
about what they consider things of
value, including education opportu-
nities, dinners, and tickets to events
and activities. When dealing with
the anti-kickback statute, physicians
should be concerned about conse-
quences of all actions, he said.
Ms. Simerson discussed elec-
tronic health records (EHR), asking
the audience if they have integrated
these records into their practice. She
highlighted some of the "traps" in-
volved with EHR, the first of which
was password protection. HIPAA pri-
vacy and security rules require that
each user has a separate login and
password in order to identify and
track users, she said. Practices must
implement procedures for monitor-
ing login attempts.
Monitoring who signs off on
chart notes is important as well, she
said. Another key point with EHR is
the role of order and timing. Both of
these become evident when keep-
ing track of records electronically,
Ms. Simerson said, so you have to
be thoughtful about what you are
doing.
